That's what I thought too until they had 3 monkeys looking at my P10 VE on my last smog test attempt. You'd have to be pretty creative to fake it since you have to run the EGR pipe. Somehow you would have to cap off one of the ends so you won't end up with an exhaust leak or JB weld it onto the cap on the exhaust manifold to make it look like it's attached. :o

Anything that makes it look like its on, but can easily be pulled off.
