I'd say if you still have something in writing (email, PM, original ad) clearly stating 100% rust free, you very much have a legal case and can take it to court if you wanted to go that route!

I purchased the car for $2400. What kind of renumeration should I expect? Perhaps get someone to fix the rust in that one spot and go to him with the bill? Or just ask for $400 back to cover a bit of the expenses?

rust repair isn't cheap

I'd get 3 different estimates on proper repair (cutting out and welding in new sheet metal the only way to go for proper rust repair in your extreme case of rot holes like that)

...and then present that to the seller to pay for the repairs. I think that is very fair in this case and I suspect it will cost more than $400 to fix

here is a copy of the pm I sent him to keep it on the up and up.

"Hey man, It's with sadness that I write this email to let you know the issue I'm faced with regarding the NX I purchased in November. The ad stated the nx was mint, and in numerous phone calls I was assured the nx was 100% rust free; to the point where the seller had a huge story about it's coming from a 'never being driven' in ohio to phoenix where the car was for most of its life. These claims would be true were it not for the giant rust hole in the wheel well. It's costing me $800 and a giant favor from a friend of mine to take care of. After discussing with the forum here (in this thread)

It comes with an understanding to me that the seller did not check over the car as I requested, as the person I sent down was not to need to check the car over but to simply drive it home with the understanding that the car was 100% rust free as I was lead to believe.
Now, I understand that it has been a few months, but the discussion has been that there is no possible way this vehicle was rust free prior to it coming here and being stored since, and therefore it is not unreasonable to ask for a partial refund to simply cover the costs of fixing the hole. Since I wish to keep things on the up and up and not soil your name on the forum, I believe $400 (half the cost of fixing this rust hole) should be adequate."

That's only fair that the seller should pay at least the $400 for the repair after the rust free claim was used before in selling the NX to you. It's strange that i almost bought this car here in Phoenix but something just wasn't right about how it was being sold. Chris101 is spot on about what to do in this situation. Bottom line, if you buy a B13 or any 15-20 year old car from the Southwest, Carfax it's history to insure the higher probability of no rust. Better yet inspect the vehicle in person before negotiating a sale so that you know whay you are getting for your money. Canx2K, I wish you could have had some way to see it personally and inspect it before you bought it but your situation at the time didn't allow that.

hate to break it to you but somebody has to. You bought a car sight unseen, you didnt go yourself to inspect the car, the car was registered in ohio (red flag) you bought the car in november and now find this, you bought an used car sold as is and you expect the seller to refund you money. It is nobodys fault but your own, when buying a car you should be the one looking over the car and not going off of somebodys word.

Andrew the nx guy himself , before i would have even asked for a picture of the whole car i would have asked for a pic of the strut towers. I dont care if the rest of the car is full of dings and scratches because thats easy to fix. every nx i have bought has been like this or in most cases worse but i buy mine for next to nothing. Out of all honesty you should have noticed this the day you got it and sent him a call but at the end of the day it comes down to you not asking for pictures of the strut towers. no matter how much a guy smooth talks you unless you have pictures or see it in person he can make a sale you may regret in the end. If you were to take it to a shop to fix that it will cost more then 400 to fix the speaker sized holes you have their if you want a proper job done like factory you will easily be over 1500 in the hole.

I ordinarily would agree with you here but you'd think the guy would have SOME scruples in knowing he's selling to a guy in another country who asked a hundred times if it was rust free and was assured as much. The integrity of the seller should come through if he is even the slightest bit honest. To lie about a vehicle is fraud is it not? Sight unseen or not, the seller has to be 100% honest with all questions.
