Call your insurance company and let them take over.

I agree but call *HIS* insurance company first. File the claim. Go thru the steps.

Subrogation.

AIS but i get paperwork from mercury insurance? oh and i only have liability on my car.

Edit: i just called them and looks like he does have insurance. they took my claim and yeah i have an appointment to get my car to get looked at. The person asked what parts were damaged. i said," the bumper, headlight and other stuff" she mentioned at the end of the call that the call was indeed monitored which got me feeling anxious because I feel like they might F* me over because i didn't say that this and that was also damaged.

Oh, i haven't filed a police report, so i'm not sure if it's necessary? also the representative wanted the pictures that i took. hmmm should i still send them? i guess i have to now.

If it didn't occur on public property and can be handled through insurance as he is admitting fault, then no need for police. If you call them, they won't come out and will tell you the same thing. Yes send the pics and more. They need it to assess the damage and come up with a value they are willing to spend before you get an actual quote from a body shop. Seems like to me they are trying to be cheap and not send a person.

Absolutely send in your pics....they're probably more thorough anyway! You are not a mechanic (even tho you might be)...they will base the claim off the findings of the body shop. And even then, that number is an "offer" which you can reject if you feel something else was damaged in the accident that the body shop didn't cover.

A police report is not necessary and they wouldn't issue any citations after the fact anyway.e police call it a "blue form" here...it's simply a form that details the events that happened and both parties information. It would have been great if the police showed up at the time of the accident because you would have known for sure if he had insurance or not.

Glad the other dude had insurance! Now you just might have to fight them from totaling your car like I did with my NX.

a police report is necessary when you have someone hit you who won't admit fault.. it helps with insurance in that case.

Honestly, the way they're doing it is better and faster. Certain shops have built a good reputation (a requirement) such that the insurance company does not need to send their own adjuster because they will take the body shop at their word. It's faster for the same reason...no need to wait for adjuster and the body shops can start the work immediately. It can suck when you have a good body shop you use that happens to NOT be a 'select service' shop (that's what State Farm called them). It is certainly your right to choose your own body shop but then you're forced to wait for an adjuster to make it out at their convenience.

I guess then if that's the case you can really nit pick everything and sneak in a few extras on the insurance dime... like that unpainted fender I'd say got damaged and have the insurance pay the color match and new fender
