side by side the two stacks are identical, although i do believe the new stack is from a b13 lsd box?

Stack is identicle, just checked the thread i had posted on lookin for the stack. It is a b14 stack, so thsi makes things even more curious, as to why the case wont fit back together.

we should see how well the old stack fits in the hole, i know i tried but i did it up side down.. if it fits better we'll swap the bearing

Saw you talking in chat too, maybe the problem is already solved? My first guess is that you're not moving the gear stack around and lining up the bearing with the hole in the case (the bearing needs to slide into the wide hole in the "top" of the case).

Problem is the gear stack doesnt really want to move around, tryed prying it even, its being stubborn.

I understand that they look the same but unless you mic. them you will see that some gears are bigger than others.
The problem you are having is that you have two gears that are of similar size and it's causeing the stack to spread apart so the top of the input shaft stack is not going into it's place in the top case.
you have mismatching stacks not bearings.
Just to put more truth to it.
I bet that when you put the caseing over the other, the bellhousing casing has two alignment pins one is located near the speedo area and the other near the plug where you add oil, they are across from eachother.
O.k. now when you put the top casing on the alignment pin(located to the rear of the tranny near the speedo) and the top casing hole match up but the one towards the front is still about half inch off.

The gear stack are spread apart due to mismatching gears.

Its just the stacks are both for a b14, so for the same exact tranny, so their shouldnt be any difference. .Guess we can try puling back out the new stack and switching around tos ee if we have the same problem.

Regarding the whining, does it sound like the bottom gear of the stack constantly grinding on the final drive/lsd unit?

You only replaced one stack? Why not swap them both over if you have the other? May be reading wrong here.
